TERMS OF SALE
Orders can only be accepted from persons over the age of 18. By ordering from us you represent to us that you are over the age of 18.
You warrant that all details you provide to bernieandthebeanpole.com for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.
We must receive payment for the whole of the price of the goods before your order can be accepted. You will receive an email acknowledging receipt of your order – this does not constitute acceptance of your order. Once we have sent you an email confirmation that your goods have been dispatched, then we have accepted your order and a contract exists between us.
Despatch times may vary. Bernie and the Beanpole cannot be responsible for any delays resulting from postal delays. Please see our Delivery Policy for further details.
DISTANCE SELLING REGULATIONS
Under the UK Distance Selling Regulations all EU customers may cancel any purchase within 7 working days, beginning with the day after receipt of the item. Please contact us at email@example.com should you wish to do so. Any cancelled item must be returned to us in its original condition at your cost.
All orders are subject to acceptance and availability. Every effort is made try to ensure that all information displayed on our Website is accurate, however errors may occasionally occur. If we discover an error in the price of goods that you have ordered we will inform you of this as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it. If we discover that there is no availability of the product that you have ordered then we will inform you of this and give you the option of purchasing an alternative product or cancelling the order.
We reserve the right to change any product, product prices, product specification and availability at any time.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing at the address stated in the confirmation email within 14 working days of delivery of the goods plus return the goods to us. This provision does not affect your statutory rights.
We have made every effort to display all product images and garment colours accurately but browser software and monitor displays may sometimes cause colour variations and we cannot be responsible for any discrepancies between the image and the actual product.
We have taken every measure to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers.
We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.
Our liability shall be limited to refunding, repairing or replacing any defective or missing products and in any event shall not exceed the price paid for the products. Bernie and the Beanpole shall not be liable for any delays or failure in performing any of its obligations in relation to its products if the delay or failure is beyond our reasonable control.
